NoViolation Terms of Service

These Terms of Service ("Terms") govern your access to and use of NoViolation, a service operated by J3 Foundry, LLC ("J3 Foundry," "NoViolation," "we," "our," or "us"). By creating an account or using NoViolation, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region). Users aged 13–17 may use NoViolation only with parent or legal guardian consent. By using NoViolation, you confirm you meet these requirements.

2. Accounts

• You are responsible for safeguarding your login credentials.
• Do not share your account or use NoViolation for unlawful purposes.
• We may suspend or close accounts involved in abuse or security risks.

3. User Content & License

You retain full ownership of videos, files, and other material you upload. By uploading, you grant NoViolation a worldwide, royalty-free license to:

• Analyze and process your content,
• Display or reproduce it as needed to operate and improve our service,
• Use anonymized examples for research or promotional purposes (unless you opt out).

You can opt out of promotional use anytime by emailing info@noviolation.ai. Revocation applies prospectively and doesn’t affect lawful prior uses.

We may retain uploaded data for up to 30 days after account closure for service, compliance, or fraud-prevention purposes.

4. Prohibited Uses

You agree not to:

• Upload or share content that is illegal or violates anyone’s intellectual property or privacy rights.
• Interfere with, hack, or disrupt our systems.
• Automate scraping or misuse our scanning tools.
• Attempt to bypass limits on scans or API calls.

5. Payments, Trials & Refunds

• Some features (subscriptions or one-off scan packs) require payment via third-party processors (e.g., Stripe).
• Subscriptions renew automatically unless you cancel before the next billing cycle.
• We offer a trial of 5 scans to new users.
• Refunds or disputes may be handled by email at info@noviolation.ai or through Stripe’s dispute tools.

6. Privacy & Data

We collect limited personal data, such as:

• Login credentials,
• Billing information,
• IP address and device ID (for security and abuse prevention).

We do not transfer user data outside the United States.

7. Disclaimers

• NoViolation analyzes content and offers guidance only.
• We cannot guarantee that TikTok or any platform will avoid issuing violations, even if our tools give a “clear” signal.
• The service is provided “as-is,” without warranties of reliability, accuracy, or fitness for a particular purpose.

8. Limitation of Liability

To the fullest extent allowed by law: NoViolation and J3 Foundry are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is capped at the amount you paid us in the preceding 12 months.

9. Dispute Resolution & Governing Law

These Terms are governed by the laws of Michigan, USA, without regard to conflict-of-law principles. Any dispute will be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may bring claims in small-claims court, and you waive the right to a jury trial.

10. Termination & Data

You may close your account at any time by contacting info@noviolation.ai. Upon request, we will give you an opportunity to download your content before closure. We may keep some data as necessary for fraud prevention, legal obligations, or to resolve disputes.

11. Third-Party Services

We use OpenAI’s large language models to assist with content analysis. Use of our service is also subject to the terms of those providers.

12. Indemnification

You agree to defend, indemnify, and hold harmless J3 Foundry, LLC, NoViolation, and our affiliates, officers, employees, and contractors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of NoViolation;
• Your violation of these Terms; or
• Your uploaded content, including any claim that it infringes or misuses the rights of a third party.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

13. Changes to These Terms

We may update these Terms to reflect changes to our service or the law. If updates are material, we will notify you (e.g., via email or app notice). Continued use after changes means you accept the revised Terms.
